Terms of Use

1. Acceptance of Terms

Welcome to Gobostock. By accessing or using our website, services, and AI-powered image generation tools (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after any changes constitutes acceptance of the modified Terms.

2. Description of Service

Gobostock provides an AI-powered platform for generating, editing, and purchasing digital images and videos. Our Service includes:

• AI image generation using various models (Flux, GPT Image, Gemini / Nano Banana, Seedream, Recraft, Riverflow, and others)
• AI video generation and editing tools
• Image editing and enhancement features
• A marketplace for buying and selling AI-generated content
• Collections and gallery organization tools

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Keep your password secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. User Content and Conduct

You are solely responsible for any content you create, upload, or share through our Service. You agree NOT to:

• Generate or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Generate, upload, or share sexually explicit content, pornography, or nudity intended for sexual gratification. This is a strict prohibition and applies regardless of the subject's age, whether the content is photographic or synthetic, and whether or not it is offered for sale
• Generate or share any sexual content involving, or appearing to involve, a person under 18. This is never permitted under any circumstance. Suspected child sexual abuse material is reported to the National Center for Missing & Exploited Children and to law enforcement, and the account is closed
• Create content depicting minors in any inappropriate context
• Publish an intimate image or video of an identifiable person without that person's consent, including synthetic or AI-generated depictions
• Generate content that infringes on intellectual property rights of others
• Create deepfakes or misleading content of real individuals without consent
• Use the Service for spam, phishing, or malicious purposes
• Attempt to reverse engineer, hack, or compromise our systems
• Circumvent any rate limits, usage restrictions, or security measures
• Resell, sublicense, or redistribute access to our AI models or Service
• Use generated or licensed images, videos, audio, prompts, or generation recipes to train, fine-tune, distill, benchmark, evaluate, or otherwise develop an AI or machine-learning model, dataset, or similar system, except as expressly allowed in Section 12.1 and the Content License
• Use outputs from a third-party model to develop models or products that compete with that provider, including OpenAI, Google, Recraft, Black Forest Labs, ByteDance, Sourceful, or Alibaba Cloud

We reserve the right to remove any content and terminate accounts that violate these guidelines without prior notice.

4.1 Reporting content and takedown requests

Anyone may report content on Gobostock, whether or not they hold an account, using our report form. You do not need to be a customer to ask us to remove something.

We act on valid requests concerning an intimate visual depiction published without the consent of the person shown — including AI-generated depictions — within 48 hours of receiving the request, and we make reasonable efforts to remove known copies. Reports of content involving a minor are treated as urgent and escalated immediately.

Copyright claims must identify the work, state your relationship to it, and are made under penalty of perjury. We will ask for documentation of ownership before removing material, and we notify the contributor so that they may respond.

5. Intellectual Property Rights

5.1 Your Content

You retain ownership of the prompts and creative direction you provide. For AI-generated content created using our Service with a paid subscription, you receive a commercial license to use, modify, and sell that content, subject to these Terms.

That commercial license is a usage license for finished projects. It does not include the right to use generated content, generation recipes, or derivatives as training, fine-tuning, distillation, or evaluation data for AI or machine-learning systems. Third-party model providers restrict those uses, and Section 12.1 and the Content License pass those restrictions through to you. You may not permit employees, contractors, clients, or other end users to do what you may not do.

5.2 Our Platform

Gobostock and its licensors retain all rights to the Service, including but not limited to our website, AI models, software, branding, and proprietary technology. You may not copy, modify, or create derivative works of our platform without written permission.

5.3 Marketplace Content

Content purchased through our marketplace grants you the license specified at the time of purchase. Standard licenses are for personal and commercial use but do not transfer copyright ownership. Buyer licenses are governed by the Content License.

If you submit media for sale, your submissions are governed by the Contributor Terms. You grant Gobostock a broad non-exclusive marketplace usage grant to host, market, price, license, package, and commercially exploit accepted assets as described in those terms. Fully AI-generated works may have no US copyright; the grant covers contractual usage rights even when copyright is absent. Where a human-authored contribution is protected, you keep that copyright and license it to Gobostock on the same operational terms. Buyers receive a Content License (usage rights), not a transfer of copyright.

6. Payment and Subscriptions

Generation requires a paid subscription. Each plan includes a monthly credit allowance, and credits are not sold separately. By subscribing or making a purchase:

• You agree to pay all applicable fees and charges
• Subscriptions auto-renew unless canceled before the renewal date
• Each billing period starts with your plan's full allowance; credits unused at the end of a period expire and do not roll over
• Credits have no cash value and are non-refundable once used for generation
• Credits used for a generation that our content checks or the model provider's safety systems withhold are not refunded, because the generation was performed and its resources consumed
• Credits for a generation that fails on our side or the provider's, with nothing generated or delivered, are refunded automatically
• Prices may change with reasonable notice
• You are responsible for all taxes applicable to your purchases

Refunds for subscriptions and marketplace licenses are governed by our Refund Policy.

Buyer card payments for marketplace licenses are processed by Stripe. Contributor cash-outs, when enabled, use a third-party payout provider (Stripe Connect) after identity and tax details are complete. Gobostock does not collect Social Security numbers or bank account numbers itself for Connect payouts.

6.1 Cancellation

You may cancel or switch to a lower paid plan at any time. Paid benefits continue until the end of the then-current billing period, after which the account moves to Free (or to the lower plan you selected). Unused monthly credits do not roll over and are not refunded on cancel.

7. Storage and Content Retention

Storage on the Service is a convenience for creating, not an archival or backup service. We may remove unpublished content under the rules below even when that content is below any storage allowance shown on the Subscription page.

7.1 Upload storage

Paid plans include an advertised upload storage allowance for files you upload (for example reference images and Design Studio assets). Current allowances are listed on the Subscription page and may change with notice. Free accounts have no upload storage. If you cancel or downgrade below your usage, we may block new uploads and may delete excess or unused uploads.

After a paid plan ends, we may delete user uploads and Design Studio assets after a short grace period. That grace is typically seven (7) days for accounts with less than sixty (60) days of paid history, thirty (30) days for accounts with at least sixty (60) days of paid history, and up to ninety (90) days for accounts with at least twelve (12) months of paid history. Longer grace is at our discretion and is not guaranteed.

7.2 Private generations

Unpublished (private) AI generations are stored while you have an active paid subscription, subject to fair-use limits and age-based cleanup of older unpublished files. They are not a backup service. After your paid subscription ends, we may delete private generations even if they were under your previous storage limit.

We do not guarantee retention. For accounts with at least sixty (60) days of paid history we generally aim to retain private generations for up to ninety (90) days after the plan ends. For shorter paid history (including a single billing month) we may delete private generations sooner, typically after fourteen (14) days. Resubscribing before deletion generally restores access, subject to the limits of the plan you choose.

7.3 Marketplace listings

Content published and accepted on the marketplace is retained according to the Contributor Terms and is not deleted solely because you cancel a subscription. You remain responsible for downloading copies of private work you want to keep.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• AI-generated results will meet your specific requirements or expectations
• Any errors or defects will be corrected
• The Service is free of viruses or harmful components

AI-generated content may occasionally produce unexpected, inaccurate, or inappropriate results. You are responsible for reviewing all generated content before use or publication.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOBOSTOCK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use the Service
• Unauthorized access to or alteration of your data
• Actions of third parties on or through our Service
• Service interruptions, bugs, or technical issues

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

10. Security Incidents and Data Breaches

While we implement industry-standard security measures to protect your data, no system is completely secure. In the event of a security breach:

• We will notify affected users as required by applicable law
• We will take reasonable steps to mitigate the impact
• We are not liable for damages resulting from breaches caused by sophisticated attacks, zero-day vulnerabilities, or circumstances beyond our reasonable control
• You acknowledge that you use the Service at your own risk

We strongly recommend not uploading sensitive personal information, financial data, or confidential business materials to our Service.

11. Indemnification

You agree to indemnify, defend, and hold harmless Gobostock and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create, upload, or share through the Service
• Your use of generated or licensed content in violation of third-party model terms, including AI-training restrictions

12. Third-Party Services

Our Service may integrate with or link to third-party services (payment processors, AI model providers, cloud storage, etc.). We are not responsible for the practices, content, or availability of these third-party services. Your use of such services is governed by their respective terms and policies.

12.1 Third-party model output restrictions

Images, video, audio, and other outputs you generate on Gobostock are produced by third-party models. Those model owners restrict using outputs to train, fine-tune, distill, or develop AI systems. A commercial usage license from Gobostock does not waive those rules. You must comply with the terms that apply to the model you used, however Gobostock reaches that model. You may not permit end users of your work to violate those terms.

Without limiting the Content License, the following restrictions apply to generated outputs:

• OpenAI (GPT Image 2 and other OpenAI image models): You may not use Output to develop artificial intelligence models that compete with OpenAI's products and services. OpenAI currently describes limited exceptions only for internal classifiers or embeddings that are not distributed or sold to third parties, and for fine-tuning OpenAI's own services where OpenAI permits it.
• Google (Nano Banana 2, Nano Banana Pro, Gemini image, and Imagen): You may not use the services or generated output to develop models that compete with Google's Gemini API, Google AI Studio, Imagen, or other Google AI/ML services, or to create or improve models similar to a Google Model.
• Recraft (V4.1, Utility, Pro, and Vector): Assets may not be used to train any artificial intelligence model, system, network, or similar technology, and may not be used to develop goods or services that compete with Recraft.
• Black Forest Labs / Flux: You may not use Flux output to train, fine-tune, or distill a model that competes with a FLUX model or with Black Forest Labs, or to train other AI models on that output unless you have a separate synthetic-data license from Black Forest Labs.
• ByteDance / Seedream: You may not use Seedream input or output to develop, train, annotate, fine-tune, optimize, or iterate new or other models except as ByteDance expressly agrees.
• Sourceful / Riverflow: You may not, and may not allow third parties to, use Riverflow results to create, train, test, or improve any machine-learning algorithms or artificial intelligence systems.
• Alibaba / Qwen (hosted APIs): You may not use hosted output to train or develop products or services that compete with Alibaba Cloud or its affiliates.

Marketplace purchases are also governed by the Content License, which includes the same AI-training restrictions. These provider rules survive account closure. They do not change Gobostock's own processing described in the Privacy Policy.

13. Service Modifications and Termination

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Change pricing, features, or availability of AI models
• Terminate your account for violations of these Terms
• Remove content that violates our policies

We will make reasonable efforts to provide notice of significant changes, but are not obligated to do so.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
