Designated agent

Send copyright notices and counter-notices to our designated agent:

Copyright Agent, TARNIVO LABS LLC
1209 Mountain Road Pl NE, Ste R

Albuquerque, NM 87110

United States

Phone: +1 (505) 221-2061
Email: contact@gobostock.com (subject line "DMCA notice")

This address is for copyright matters only. For other problems with content, such as an intimate image shared without consent, a cloned voice or likeness used without permission, or content involving a minor, use the report form, which does not require a DMCA notice.

Sending a notice

A notice must be in writing and include, as 17 U.S.C. § 512(c)(3) requires:

  1. a physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf;
  2. identification of the copyrighted work claimed to be infringed or, if several works are covered by one notice, a representative list of them;
  3. identification of the material claimed to be infringing and information reasonably sufficient for us to locate it, such as the address (URL) of each listing or page;
  4. your contact information: name, postal address, telephone number, and email address;
  5. a statement that you have a good-faith belief that the use of the material in the way complained of is not authorized by the copyright owner, its agent, or the law; and
  6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

Please consider whether the use may be fair use or otherwise allowed before you send a notice. Under 17 U.S.C. § 512(f), a person who knowingly misrepresents that material is infringing may be liable for damages.

What happens next

When we receive a notice that substantially complies with these requirements, we promptly remove or disable access to the material and notify the person who posted it, with a copy of the notice. That copy may include your name and contact details, so that they can respond. If a notice is missing a required element, we tell you what is missing. Removing a marketplace listing takes it off sale; licenses already granted to buyers are handled as the law requires.

Counter-notices

If your material was removed and you believe that was a mistake or misidentification, you may send our agent a counter-notice that includes, as 17 U.S.C. § 512(g)(3) requires:

  1. your physical or electronic signature;
  2. identification of the material that was removed or disabled and where it appeared before it was removed;
  3. a statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification; and
  4. your name, postal address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is (or, if your address is outside the United States, any judicial district in which TARNIVO LABS LLC may be found), and that you will accept service of process from the person who sent the notice or that person's agent.

We send a copy of a valid counter-notice to the person who sent the original notice. Unless that person tells us, within 10 business days, that they have filed a court action seeking to restrain the activity, we restore the material between 10 and 14 business days after we received the counter-notice.

Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe copyright. Each valid notice that is not withdrawn or successfully countered counts as a strike. An account with three strikes within twelve months is closed, and we may close an account sooner for flagrant or deliberate infringement. A closed account's holder may not open a new one.
